Terms of Use

These terms are an agreement between you and Setout Labs LLC ("we", "us") covering your use of the Zerohour mobile app. By downloading or using the app you agree to them. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old and able to enter a binding agreement to use Zerohour. If you are under the age of majority where you live, you may use the app only with the consent of a parent or guardian.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Zerohour on devices you own or control, for your own non-commercial use, subject to these terms and to the rules of the app store you downloaded from.

3. Caffeine estimates are not medical advice

Zerohour shows estimates of circulating caffeine based on stated assumptions: a nominal half-life, a simplified absorption model, the clearance speed you entered, and the milligram figures attached to the drinks you logged. It is not medical advice, not a diagnosis, and not a medical device.

Real caffeine metabolism varies widely between people and from day to day, and the milligram content of a real drink varies between batches, roasts and pours. Do not use Zerohour to make medical decisions or to manage a health condition. Talk to a qualified clinician about caffeine, sleep, pregnancy, medication interactions or any symptom that concerns you.

4. Acceptable use

You agree not to:

  • use the app for any unlawful purpose or in violation of any applicable law;
  • reverse engineer, decompile, or attempt to derive the source code of the app, except where that restriction is prohibited by law;
  • interfere with, disrupt, or attempt to gain unauthorized access to the app; or
  • distribute malware or otherwise attempt to damage the app or another user's device.

5. Intellectual property

Setout Labs LLC owns Zerohour, including its software, design, text, drink database and marks. These terms grant you a license, not a transfer of ownership. The entries you create in your own log are yours, stay on your device, and we claim no rights in them.

6. Purchases

Any purchases offered in the app are processed by the app store you downloaded from, under that store's terms. Prices, taxes, receipts, restores and refunds are handled by that store. We do not process payments and cannot issue refunds directly.

7. Third-party services

Your use of the app store, your device platform, and any other third-party service is governed by that provider's terms and privacy policy. We are not responsible for those services.

8. Termination

You may stop using Zerohour at any time by deleting the app. We may suspend or terminate your license if you materially breach these terms. Sections that by their nature should survive, including disclaimers, limitation of liability, indemnification and governing law, survive termination.

9. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its estimates will match your actual physiology. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, Setout Labs LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of sleep, health or opportunity, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim or fifty U.S. dollars (USD $50).

11. Indemnification

You agree to defend and indemnify Setout Labs LLC against claims, damages and costs arising from your misuse of the app or your violation of these terms or of applicable law.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute, and you consent to their jurisdiction.

13. Changes to these terms

We may update these terms. We will update the effective date above, and for material changes we will give notice in the app. Continuing to use Zerohour after a change means you accept the updated terms.
